SteadyRyze Terms of Use

Effective Date: October 19, 2026

These Terms of Use ("Terms") are an agreement between you and SteadyRyze LLC ("SteadyRyze," "we," "us," or "our"). They govern the SteadyRyze mobile app, the website at https://steadyryze.com, the waitlist, accounts, subscriptions, support features, and related services (together, the "Service"). The mobile app is licensed under these Terms; it is not sold to you.

Important: The Service provides migraine and related symptom education and self-management support. It does not provide medical advice, diagnosis, treatment, clinical monitoring, or emergency care. Section 4 explains these limits. Section 14 requires most disputes to be resolved through individual arbitration and explains how to opt out.

1. Acceptance and Changes

By affirmatively accepting these Terms when prompted, creating or using a SteadyRyze account, purchasing a subscription, or using the Service after being presented with these Terms, you agree to them. If you do not agree, do not create an account or use the Service. If you use only public website pages, these Terms apply to that use to the extent permitted by law.

Our Privacy Policy at https://steadyryze.com/privacy-policy explains how we handle information. Agreeing to these Terms does not replace any separate consent required to process health-related information or optional analytics.

We may update these Terms as the Service changes. We will post the revised Terms and their effective date. For material changes, we will provide advance notice and seek renewed acceptance where required or appropriate. Changes to Section 14 will apply only to disputes arising after the new version takes effect, unless you agree otherwise. Continued use after a valid update takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and manage any active subscription through the applicable app store.

2. Eligibility and Accounts

You must be at least 13 years old and reside in the United States to create an app account. If you are 13 through 17, a parent or legal guardian must provide their name and email address and affirm their consent during signup. You must be at least 18 years old to purchase a subscription. A parent or legal guardian may purchase through the applicable app store for a minor's use, subject to that store's rules. You must provide accurate account information and keep it reasonably current. You may not create an account for someone else without our authorization, except when acting as the parent or legal guardian of a minor under these Terms, or share your account credentials. You are responsible for activity under your account, except to the extent caused by our own conduct or security failure. Tell us promptly at [email protected] if you suspect unauthorized access.

Public website pages may be viewed without an app account. Waitlist and other website forms remain subject to the age and parental-permission rules in our Privacy Policy. We do not knowingly collect information from children under 13.

We may verify eligibility and may refuse, suspend, or close an account that does not meet these requirements, subject to applicable law. If you believe we have an account for someone under 13 or a minor without parent or guardian consent, contact [email protected].

3. The Service and Your Responsibilities

SteadyRyze offers learning content, symptom and pattern tracking, reminders, flare support, and personalized self-management tools. Features may change, become unavailable, or require a compatible app version, device, operating system, internet connection, or active subscription. We do not promise that the Service will be uninterrupted, error-free, or available in every location or on every device.

You are responsible for the accuracy and completeness of information you enter, for deciding whether and how to use educational content, and for keeping independent copies of information you need. You may share your own records with a healthcare professional. Do not enter information about another person unless you have the right to do so.

4. Medical and Emergency Limitations

SteadyRyze is for education and self-management support. It is not a healthcare professional, medical service, or emergency response system. It does not diagnose, cure, mitigate, treat, or prevent disease; provide medication or dosage instructions; review your account through a clinician; or create a clinician-patient relationship. The app is not FDA-cleared or FDA-approved and is not intended to be used as a regulated medical device.

Personalized content comes from automated app logic using information you provide and your app activity. It may be incomplete, inaccurate, or unsuitable for your situation. Do not use it to make medical decisions, ignore professional advice, or delay seeking care. Ask a qualified healthcare professional about symptoms, treatment, or changes in your health.

We do not monitor entries for emergencies or promise to identify urgent symptoms. If you may have a medical emergency, call 911 or seek urgent medical help. An in-app emergency action, if available, only opens your device's phone interface; SteadyRyze does not place or monitor the call. Do not use support or privacy email for urgent medical questions.

5. Subscriptions, Billing, and Credits

Access to paid app features requires a verified, active subscription. At launch, SteadyRyze offers monthly and yearly plans through the Apple App Store or Google Play. The applicable store displays the current price, taxes, billing period, and any offer terms before you confirm a purchase. Prices may vary by store or location and may change under the store's rules and applicable law.

Subscriptions renew automatically until canceled. The app store charges your chosen payment method and manages billing. You must cancel through the Apple App Store or Google Play, as applicable, before the next renewal if you do not want another charge. Deleting the app or your SteadyRyze account does not cancel a store subscription. A cancellation generally ends future renewal; access may continue through the paid period as determined by the store and your verified subscription status.

We do not offer a standard introductory free trial at launch. We may, at our discretion, grant service credits that extend an existing subscription. A service credit has no cash value, is not transferable or redeemable for cash, and does not by itself cancel automatic renewal. Its effect on the next billing date depends on the applicable store's processing and the terms shown to you. We may limit or refuse credits to prevent error, fraud, or abuse, subject to applicable law.

Purchase verification, restoration, failed payments, billing grace periods, refunds, and payment disputes depend in part on the applicable store. Start a refund request through Apple or Google; if the store directs you to us, contact [email protected]. SteadyRyze does not offer direct cash refunds except where required by law. Contact [email protected] if a verified purchase does not appear in your account.

6. SteadyRyze Intellectual Property and Your License

SteadyRyze owns the app, software, design, text, lessons, images, audio, tools, branding, trademarks, and other content it provides through the Service ("SteadyRyze Content"), except material that belongs to a third-party licensor. These Terms do not transfer ownership of SteadyRyze Content to you.

While you comply with these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service and SteadyRyze Content for your own noncommercial purposes. For the iOS app, this license is limited to Apple-branded products you own or control and use permitted by Apple's usage rules, including permitted Family Sharing where available. No other rights are granted.

Except as permitted by law or our written permission, you may not copy, redistribute, sell, sublicense, publicly display, scrape, or commercially exploit SteadyRyze Content; remove proprietary notices; reverse engineer or attempt to extract source code; use automated access that burdens the Service; or use SteadyRyze Content to train a model or build a competing product. You may retain and share your own symptom records and information you entered.

The SteadyRyze name, logos, and other marks may not be used in a way that suggests our sponsorship or endorsement without written permission.

7. Your Information and Feedback

You retain ownership of information, notes, and feedback that you provide to SteadyRyze ("User Content"). You grant SteadyRyze a limited, nonexclusive, royalty-free license to host, store, reproduce, display to you, process, adapt for technical formatting, and use User Content as needed to provide, secure, support, personalize, and improve the Service, in accordance with our Privacy Policy and any required consent. This license includes use by service providers acting for us for those purposes. It ends when the User Content is deleted from our systems, except for permitted retention, backups, and de-identified or aggregated information as described in the Privacy Policy.

You may suggest improvements. We may use those suggestions to develop and improve SteadyRyze without paying you or assigning ownership of your feedback to us. We will not publish identifiable User Content, including testimonials, or license identifiable User Content for external use without your separate permission. We may use data derived from User Content to train models used internally to operate and improve the Service, but only after the training data has been anonymized so it cannot reasonably identify or be linked to an individual. We will not use identifiable health-related information to train models, use the anonymized data to train third-party or publicly accessible models, or make our trained models publicly accessible.

You represent that you have the rights needed to submit User Content and grant this limited license. Do not submit unlawful, infringing, malicious, or deceptive material.

8. Acceptable Use

You may not use the Service to break the law; infringe another person's rights; interfere with security or operation; attempt unauthorized access; impersonate someone else; submit malicious code; abuse support channels; or evade payment, access, or technical limits. You may not resell access or share a subscription across unrelated accounts except as expressly permitted by the applicable store and SteadyRyze.

We may investigate suspected misuse and take reasonable action, including restricting access or reporting unlawful conduct, subject to our Privacy Policy and applicable law.

9. Third-Party Services

Apple, Google, and other linked services have their own terms and privacy practices. You must comply with their applicable terms when using them. SteadyRyze is responsible for its own Service and its own handling of information as described in our Privacy Policy; a third party's separate service remains that party's responsibility.

10. Suspension, Closure, and Deletion

You may stop using the Service at any time and request account deletion at https://steadyryze.com/delete-account. Cancellation of a store subscription is a separate step. See Section 5.

We may suspend or close access if you violate these Terms, fail to meet eligibility requirements, lack a valid subscription, create a security or legal risk, or if continued operation is not reasonably possible. We will give notice and a chance to resolve the issue when reasonably practical, subject to safety, security, and legal needs. Closing an account does not erase obligations or rights that by their nature survive, including accrued payment obligations, intellectual property rights, dispute terms, and lawful data retention.

Information handling after closure is described in the Privacy Policy. We will not use account closure to deny rights that applicable law protects.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and SteadyRyze Content are provided "as is" and "as available," without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and noninfringement. We do not guarantee symptom improvement, any health outcome, uninterrupted access, or that the Service will meet your particular needs.

These disclaimers do not limit warranties or rights that cannot lawfully be disclaimed. No statement by support or other personnel changes these Terms unless SteadyRyze agrees in writing through an authorized representative.

12. Limits on Liability

To the fullest extent permitted by law, SteadyRyze LLC and its current and former owners, managers, officers, directors, employees, contractors, agents, and affiliates (together, the "SteadyRyze Parties") are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service, including lost data, lost profits, or business interruption.

To the fullest extent permitted by law, the SteadyRyze Parties' combined total liability for claims arising from or relating to the Service or these Terms will not exceed the greater of (a) $100 or (b) the amount you paid for SteadyRyze subscriptions during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited by law. They do not limit liability for conduct or harm that applicable law does not allow us to limit, or your rights to remedies that applicable law makes nonwaivable. In particular, these Terms do not waive rights under the Maine Unfair Trade Practices Act or other applicable consumer-protection law.

13. Claims Caused by Your Misuse

To the extent permitted by law, you agree to reimburse the SteadyRyze Parties for reasonable losses, damages, and costs arising from a third-party claim caused by your unlawful use of the Service, intentional misuse, material breach of these Terms, or User Content that infringes another person's rights. This does not require you to pay for a claim to the extent it was caused by a SteadyRyze Party's own conduct, and it does not limit any nonwaivable consumer right.

14. Individual Arbitration and Class-Action Waiver

Please read this section carefully. It affects how you and SteadyRyze resolve disputes and includes a right to opt out.

Informal resolution

Before either party starts arbitration, that party must send a written Notice of Dispute describing the claim, relevant account email, facts, and requested relief. Send notices to [email protected] with the subject "Notice of Dispute" or by mail to the address in Section 17. We may send a notice to the email address associated with your account. The parties will try in good faith to resolve the dispute for 30 days after receipt. This step does not replace any notice required by law or prevent either party from seeking urgent relief.

Arbitration

Except for the matters below, you and SteadyRyze agree to resolve disputes arising from or relating to these Terms, the Service, subscriptions, or your relationship with the SteadyRyze Parties through final, binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement. The arbitrator may award the same individual remedies that a court could award under applicable law. The AAA rules govern fees, and SteadyRyze will pay the fees required of the business under those rules. Hearings may be conducted remotely or in another location permitted by the AAA rules and applicable law.

Either party may bring an eligible individual claim in small claims court. Either party may seek temporary court relief to prevent imminent misuse of intellectual property or a serious security threat while the underlying dispute proceeds in arbitration. Government agency complaints and rights that cannot lawfully be forced into arbitration remain available.

Individual proceedings

To the extent permitted by law, each party may bring claims only in an individual capacity, and neither party may act as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. The arbitrator may not combine different people's claims without all parties' consent. If this waiver is unenforceable for a particular claim or requested remedy, that claim or remedy will proceed in a court with jurisdiction, while the remaining claims will proceed in arbitration where permitted.

Opt-out

You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing [email protected] with the subject "Arbitration Opt-Out." Include your full name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect your ability to use the Service. If you opt out, Section 15 governs covered disputes in court.

If the AAA cannot administer a dispute under its Consumer Arbitration Rules, the parties will try to agree on another neutral arbitration provider that applies comparable consumer protections. If they cannot agree, a court with jurisdiction may appoint an arbitrator as permitted by law.

15. Governing Law and Court

Maine law governs these Terms, excluding its conflict-of-law rules, except that the Federal Arbitration Act governs Section 14 and mandatory laws of your state of residence may apply. For a dispute that properly proceeds in court, the parties consent to the state and federal courts in Maine, unless applicable law permits or requires another court. Small claims may be brought in any court allowed by Section 14 and applicable law.

16. Additional Terms

If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law, subject to the specific rule for the class-action waiver in Section 14. A failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without our written permission. We may transfer these Terms as part of a merger, reorganization, or sale of the Service, subject to applicable law.

These Terms and any additional terms shown and accepted for a specific purchase are the agreement about the Service. If a store's purchase terms conflict with these Terms about billing or refunds, the store's terms govern that transaction to the extent required by the store or law. Nothing in these Terms limits rights that cannot lawfully be limited.

18. Additional Terms for Apple App Store Users

If you obtained the app through Apple's App Store, this section also applies:

  1. These Terms are between you and SteadyRyze, not Apple. SteadyRyze is responsible for the app and its content.
  2. Your app license is limited as stated in Section 6 and Apple's applicable usage rules, including permitted Family Sharing or volume purchasing.
  3. SteadyRyze is responsible for maintenance and support as stated in these Terms or required by law. Apple has no duty to provide maintenance or support.
  4. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price paid to Apple for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. SteadyRyze remains responsible for other claims to the extent required by law.
  5. SteadyRyze, not Apple, is responsible for addressing claims about the app, including product-liability, legal-compliance, and consumer-protection or privacy claims. SteadyRyze, not Apple, is responsible for investigating, defending, settling, and discharging third-party claims that the app infringes intellectual property rights.
  6. You represent that you are not located in a country subject to a U.S. embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on a U.S. Government list of prohibited or restricted parties.
  7. You must comply with applicable third-party terms when using the app.
  8. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you upon your acceptance.

SteadyRyze's name, address, email, and telephone number for app questions, complaints, or claims are in Section 17.
